Do any of these concerns sound familiar?

  • The insurer says it will stop paying for treatment, but you still have symptoms.
  • The other party’s insurer is not handling your injuries because you may bear a larger share of responsibility.
  • You would like help with documents, the claim process or finding an appropriate professional.
  • You feel uneasy dealing with an unfamiliar insurance procedure.

01

What is a direct victim claim?

A victim claim (higaisha seikyū / 被害者請求) is a procedure for claiming directly from the compulsory automobile liability insurer of the party responsible for the accident. Jibaiseki (自賠責) is Japan’s compulsory automobile liability insurance.

The other party’s voluntary motor insurer may handle payments together under the ‘combined payment’ system (ikkatsu taiō / 一括対応). A direct victim claim is another way to make a claim. If you are concerned about the current arrangements, ask us to explain the options for your case.

Jibaiseki covers eligible injury-related losses, not damage to a car or other property. Claims are assessed under the applicable payment standards and limits. We do not guarantee a payment, a compensation amount or a disability classification.

How Neconote can help

We work with outside professionals, including attorneys, doctors, licensed judo therapists and medical coordinators. We listen to your situation and explain the procedure, its advantages and its drawbacks.

Help with claim documents

We assist with preparing the documents for a direct jibaiseki victim claim and keep you informed as the work progresses.

Support across Japan

The Japanese service page offers procedures by telephone, LINE and post throughout Japan, without a travel surcharge. Please ask us about arrangements in your preferred language.

Referral when negotiation is needed

We are administrative scriveners (gyōseishoshi), not attorneys (bengoshi). We do not represent you in negotiations about fault or a settlement. If negotiation with the other party’s insurer is needed, we can introduce an affiliated attorney.

Understanding the options and the limits

A direct claim may be worth discussing when the other party has no voluntary motor insurance, or when you are concerned about the insurer’s handling of treatment. Whether your particular accident and costs are covered must be checked individually. A direct claim does not make every treatment cost payable or remove all limits on compensation.

03

Service fee

Consultations are free. You do not have to engage us just because you have asked for advice. We will explain the service before you decide.

¥82,500

including tax

For engagements accepted on or after 1 October 2026.

Please confirm the payment timing, any separate expenses and the treatment of an attorney-fee insurance rider with us before engaging the service. Insurance coverage depends on your policy; it is not automatic.

05

Documents for a claim

The documents depend on the type of claim and the circumstances. The following are examples from the Ministry’s guidance, not a complete checklist for every case. Our office will explain what is needed for your procedure.

  • The insurer’s claim form and an account of how the accident happened.
  • A traffic accident certificate.
  • Medical certificates, treatment statements and relevant receipts.
  • Evidence of lost income or other losses, where applicable.

Please keep the documents and receipts you already have. You can contact us before all the paperwork is ready. Use only the submission method that the office tells you to use.

Frequently asked questions

Can I change from the combined payment system?

The Japanese page explains that a change can be made before settlement. Please tell us the current stage of your claim so we can check the procedure and any relevant deadlines.

Do I have to engage you after a consultation?

No. We explain the advantages and disadvantages so you can decide after you understand them.

Can I ask anonymously?

Yes. The Japanese service page offers anonymous enquiries by telephone or LINE. Please ask how to proceed if you do not wish to give your name at the first enquiry.

Does jibaiseki pay for car repairs?

No. It covers eligible bodily injury losses, not vehicle damage. Car repair costs are dealt with separately with the responsible party or their insurer.

What happens to car repairs if I make a direct victim claim?

The Japanese page explains that the other party’s insurer can continue handling vehicle repairs even if the injury claim changes to a direct victim claim. Please confirm the arrangements in your case.

What if I have an attorney-fee insurance rider?

The Japanese page explains that such a rider may also be used for an administrative scrivener’s victim-claim service. Ask us and your insurer to confirm whether your policy covers this service and on what terms. If negotiation is needed, an attorney’s role is different from ours.

Can I engage you if I live far away?

Yes. We handle procedures across Japan by telephone, LINE and post. The Japanese page states that there is no travel surcharge. Please confirm the available language arrangements with us.

Can you negotiate the percentage of fault for me?

No. Our role as administrative scriveners does not include representing you in those negotiations. We can introduce an affiliated attorney when negotiation with the other party’s insurer is needed.

I did not report the accident to the police. What should I do?

A traffic accident certificate is needed for a jibaiseki claim. Contact the police promptly about reporting the accident; the circumstances become harder to establish as time passes.

The accident was recorded as property damage, but I later felt pain.

Please tell us how the accident was recorded and what happened afterwards. The Japanese page describes document procedures for such cases. The required documents and whether payment is available must be checked individually.

Can an injured passenger make a claim?

A passenger may be eligible for compensation. Please provide the circumstances of the accident so that the relevant insurance and the available claim routes can be checked. A payment from two policies or a particular total is not guaranteed.

Do I also need to attend an orthopaedic clinic?

Please discuss your injury and treatment with the healthcare professional treating you. Ask our office about the documents needed for your claim. This page does not advise you to omit a medical examination.

Can I claim for seitai or acupuncture?

The Japanese page distinguishes seitai, acupuncture and treatment by a licensed judo therapist. Please ask about the specific practitioner, treatment and supporting documents; do not assume that all treatments qualify for payment.

Are there drawbacks to a direct victim claim?

Engaging an administrative scrivener involves a service fee. The Japanese page also notes that payment to treatment providers may take longer than under the combined payment system because documents must be prepared and the claim assessed. The timing varies by case.

What if I need a break in treatment?

Please contact us about the circumstances and any supporting documents. The effect of a gap in treatment needs to be considered individually; no particular interval guarantees that compensation will continue or end.

When should I settle with the other party?

Please ask about the current claim position before making a decision. We can tell you the amount we have submitted to jibaiseki. If advice or representation in settlement negotiations is needed, we can introduce an affiliated attorney.

Can I change my treatment provider?

Please contact Neconote before going to a new provider. The Japanese page describes arranging contact with the new provider so that the procedure can continue.

Can you introduce a clinic experienced in traffic accident injuries?

Yes. We ask about your home or workplace area and aim to introduce a convenient sekkotsuin or seikotsuin with licensed judo therapists experienced in treating injuries.

Can I ask for help if I bear more responsibility for the accident?

Please contact us with the circumstances. Jibaiseki has rules on eligibility and reductions for serious fault. Being mainly at fault does not by itself establish the amount payable; coverage and any reduction must be checked in your case.
